These Terms of Service ("Terms") govern your access to and use of the Mondo Robotics website and online store, mobile applications, robots, controllers, firmware, software, connected features, support channels, products, content, and related services (collectively, the "Services"). The Services are operated by Mondo HK Limited under the Mondo Robotics brand ("Mondo Robotics," "Mondo," "we," "us," or "our"). Our online store is powered by Shopify.
By visiting, purchasing from, accessing, or using the Services, you agree to these Terms and the policies incorporated by reference, including our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree, do not access or use the Services.
1. Eligibility and Accounts
You must be legally capable of entering into a binding agreement in your jurisdiction. If you allow a minor to use a product or Service you own or manage, you are responsible for supervising that use and ensuring compliance with these Terms and applicable law.
You may be asked to provide account, billing, payment, shipping, or other information. You represent that the information you provide is accurate, current, complete, and lawfully provided. You are responsible for protecting account credentials and for activity conducted through your account. You may not sell, transfer, or license your account to another person.
2. Orders, Prices, and Payment
Submitting an order is an offer to purchase. An order is accepted only when we confirm acceptance and successfully process payment. We may decline, limit, correct, or cancel an order where permitted by law, including for suspected fraud, product or pricing errors, availability, geographic restrictions, or violation of these Terms. If we change or cancel an order, we will attempt to notify you using the contact details provided with the order.
Prices, discounts, promotions, and availability may change without notice. The price charged is the price shown when the order is placed, subject to correction of obvious errors and applicable law. Unless expressly stated otherwise, prices do not include taxes, customs duties, import charges, shipping, or handling. You are responsible for providing complete and accurate payment and billing information and for charges lawfully incurred through your payment method.
3. Shipping, Returns, Cancellations, and Refunds
Delivery dates are estimates unless expressly guaranteed. Delays may occur because of carriers, customs, weather, supply constraints, or other events outside our reasonable control. Delivery, title, and risk of loss are governed by applicable law and our Shipping Policy; nothing in these Terms overrides mandatory consumer protections.
Returns, cancellations, exchanges, and refunds are governed by the Return and Refund Policy and any cancellation rules displayed through the Services at the time of your request. A U.S. office or contact address listed below is not a fulfillment center or return address. Do not send a return until our support team provides the authorized return instructions.
4. Product Information and Availability
We try to describe and display products accurately, but colors, appearance, specifications, software features, packaging, and availability may differ from images or pre-launch descriptions and may change where reasonably necessary. Some announced features may be introduced, modified, or discontinued through software or firmware updates. Nothing in this section limits rights that cannot lawfully be excluded.
5. Product, App, and Device Use
Mondo robots are connected camera devices, not toys. Features such as motion control, automatic following, subject recognition, obstacle avoidance, smart camera movement, recording, and AI-assisted content processing can be affected by terrain, obstacles, lighting, weather, connectivity, battery level, sensor condition, target occlusion, software status, and other circumstances. Outputs may be delayed, interrupted, inaccurate, or unavailable.
You are responsible for maintaining control, observing the product and its surroundings, following the user manual and safety notices, and deciding whether conditions are suitable for operation. Do not rely on the product to prevent injury, property damage, or loss, and do not use it for emergency, life-safety, surveillance, law-enforcement, or other high-risk purposes unless we expressly approve that use in writing.
You agree not to:
- operate the product unlawfully, recklessly, or in a prohibited or unsafe area;
- use a camera, microphone, tracking, recognition, or recording feature in violation of privacy, publicity, data-protection, surveillance, intellectual-property, or other rights;
- interfere with people, animals, vehicles, public access, emergency services, or property;
- defeat or bypass safety, security, authorization, geographic, speed, or operational restrictions;
- reverse engineer, crack, tamper with, or modify the Services except where such restriction is prohibited by law;
- introduce malicious code, gain unauthorized access, scrape or extract data, or disrupt the Services; or
- use the Services to harass, threaten, harm, deceive, discriminate against, or unlawfully monitor another person.
6. Camera, Audio, and User Content
You retain the rights you hold in photos, video, audio, feedback, and other content you create or submit ("User Content"). You represent that you have the rights and permissions needed to capture, upload, process, share, or otherwise use User Content and that your use will not violate another person's rights or applicable law.
When you upload, sync, share, submit, or choose to process User Content through a connected feature, you grant Mondo and our service providers a limited, worldwide, non-exclusive license to host, reproduce, transmit, adapt, and process that content only as reasonably necessary to provide the feature you selected, support you, secure and maintain the Services, comply with law, or carry out another purpose you authorize. This license ends when the relevant content is deleted from our systems, subject to reasonable technical, backup, security, and legal-retention requirements.
Content you intentionally make public or share with another service may be viewed, copied, or used by others under the settings and terms of that service. We are not responsible for a third party's use of content you direct us to share.
7. Software License and Updates
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use Mondo software and firmware solely with authorized Mondo products and for your personal or internal business use. The software is licensed, not sold.
We may provide updates to improve features, compatibility, security, safety, or compliance. Some updates may be required for continued use of connected features. You may not copy, distribute, rent, sell, sublicense, reverse engineer, or create derivative works from the software except as expressly permitted by law or an applicable open-source license.
8. Intellectual Property
The Services and their text, graphics, interfaces, photographs, videos, software, designs, trademarks, logos, product names, and other materials are owned by Mondo, our affiliates, or licensors and are protected by intellectual-property laws. Except for the limited rights expressly granted in these Terms, no right or license is transferred to you.
You may use the Services for lawful personal or internal business purposes. You may not reproduce, distribute, publicly display, publish, sell, exploit, or create derivative works from our materials without prior permission, except as allowed by applicable law.
9. Feedback
If you voluntarily submit ideas, suggestions, reviews, or other feedback, you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, and display that feedback for operating, improving, and promoting the Services. You represent that you have the right to submit it and that it is accurate and lawful. This section does not apply to User Content submitted solely for a camera, editing, storage, support, or similar feature.
10. Third-Party Services and Shopify
The Services may include or link to tools, websites, integrations, software, content, or services provided by third parties. We do not control third-party services and provide access to them on an "as available" basis. Review the third party's terms and privacy notice before use.
Shopify provides the online-store platform, but purchases from our store are made directly from Mondo HK Limited. Shopify is not the seller of Mondo products and is not responsible for our sales, fulfillment, warranties, or customer support, except to the extent required by law or expressly stated by Shopify.
11. Privacy
Our collection, use, disclosure, and protection of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. Certain information processed by Shopify is also subject to Shopify's privacy notices.
12. Errors and Changes to the Services
Information may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct errors and update information where permitted by law. We may also modify, suspend, or discontinue all or part of the Services, but this does not affect rights and obligations that accrued before the change.
13. Disclaimer of Warranties
To the fullest extent permitted by law, and except for any express written warranty supplied with a product, the Services and products are provided "as is" and "as available." We disclaim implied warranties and conditions, including merchantability, fitness for a particular purpose, title, durability, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, completely secure, or suitable for every environment or intended use.
Some jurisdictions do not allow certain warranty exclusions. Nothing in these Terms excludes, restricts, or modifies a guarantee, warranty, right, or remedy that cannot lawfully be excluded, including mandatory consumer rights.
14. Limitation of Liability
To the fullest extent permitted by law, Mondo and our affiliates, directors, officers, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, savings, business opportunity, goodwill, or data, arising from or relating to the Services or products, even if advised of the possibility.
Where liability cannot lawfully be excluded, it is limited only to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such limitation is prohibited, or any other liability that cannot lawfully be limited.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Mondo and our affiliates, directors, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, your material breach of these Terms, your User Content, or your violation of another person's rights. This obligation does not apply to the extent a claim results from our own negligence, willful misconduct, or breach of these Terms.
16. Suspension and Termination
We may suspend or terminate access to an account or connected Service if we reasonably believe you have violated these Terms, created a security or safety risk, acted unlawfully, or failed to pay amounts due. Where appropriate, we will provide notice and an opportunity to cure. Provisions that by their nature should survive termination—including intellectual property, licenses already granted, disclaimers, limitations, indemnification, governing law, and dispute provisions—will survive.
17. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection rights that apply in your place of residence, any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
18. General Provisions
If a provision of these Terms is unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, reorganization, financing, sale of assets, or transfer of the relevant business. These Terms and the policies incorporated by reference constitute the entire agreement concerning the Services covered by them.
19. Changes to These Terms
We may update these Terms to reflect changes to the Services, our business, or legal requirements. We will post the revised Terms, update the "Last updated" date, and provide additional notice where required by law. Changes apply from the effective date stated in the notice and do not retroactively reduce rights that have already accrued.
